Booking Terms and Conditions
1. General
1.1. The Booking Terms and Conditions apply to the provision of activities and services by Horizon Expeditions. 1.2. Any variation from the Booking Terms and Conditions shall not be binding unless agreed in writing by Horizon Expeditions. 1.3. The Booking Terms and Conditions contain important information in relation to the participation in organised activities by the applicant and/or all members of the applicant’s party. As such the applicant acknowledges and agrees that the applicant shall ensure that he/she and/or all members of the applicant’s party are aware of and accept the Booking Terms and Conditions. 1.4. Horizon Expeditions reserves the right to make changes to the Activities if they have reasonable commercial or operational reasons for doing so. 1.5. Any typographical, clerical or other error or omission in any booking confirmation or other documentation issued by Horizon Expeditions (including any electronic documentation) shall be subject to correction without any liability on the part of Horizon Expeditions. 1.6. Horizon Expeditions complies with the requirements of the Consumer Protection (Distance Selling) Regulations 2000. 1.7. Horizon Expeditions reserves the right without prior notice to change the Clients assigned accommodation for one of equal suitability if Horizon Expeditions has reasonable commercial or operational reasons for doing so.
2. Safety
2.1. There are some inherent risks associated with Outdoor Activities. These Activities may be physically and emotionally challenging. All participants will receive appropriate training from a suitably qualified instructor prior to commencing the activities. No participant will be pressurised into taking part in any activity they are not happy to participate in. 2.2. Horizon Expeditions reserves the right to refuse participation on any Activity or to remove a participant from any Activity should it be deemed necessary to do so. This includes but is not limited to any participant who does not comply with the safety rules, advice and the safety systems or who is deemed to be under the influence of alcohol or drugs. 2.3. Horizon Expeditions operates a no smoking policy during the activity sessions. Participants may smoke between activities at the discretion of Horizon Expedition’s staff. 2.4. Participants may not consume alcohol before or during any activity session. Any participant deemed to have consumed alcohol will be immediately excluded from the session. No refund will be payable and additional charges may apply if the participant has to be transported away from the activity for safety 2.5. All participants are required to wear the relevant safety equipment, provided by Horizon Expeditions and fitted by an instructor. Failure to do so may result in the participant being excluded from the activity session. 2.6. Some activities may be physically demanding and require a degree of agility, strength and stamina. If participants are in any doubt as to whether they should attempt the activities they must consult Horizon Expeditions before doing so. Participants with any medical concerns are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely they could be involved in any incident which might result in injury to themselves or others (including pregnancy). 2.7. All participants are required to act responsibly and courteously at all times to other participants and Horizon Expeditions staff. Horizon Expeditions shall be entitled to exclude any person from undertaking or completing the Activities in the event of unsuitable behaviour by a participant. 2.8. Participants must be dressed appropriately (see clause 5) and Horizon Expeditions reserves the right to refuse admittance to the Activities by any participant who is not appropriately dressed 2.9. The Activities will run in most weather conditions. 2.10. No refunds or compensation will be payable by Horizon Expeditions in the event that any participant is not permitted to, or decides not to undertake or complete the Activities for the reasons set out in this clause.
3. Booking Confirmation
3.1. These Booking Terms and Conditions incorporate a Horizon Expeditions Acknowledgement of Risk Form. All applicants and/or members of the applicant’s party over the age of 18 will be required to sign the Acknowledgement of Risk Form before being allowed to undertake the Activities. Anyone under the age of 18 shall only be permitted to take part in the provided activities if the Horizon Expeditions consent form is signed by a parent or legal guardian 3.2. All applicants must advise Horizon Expeditions as soon as possible of any errors in the booking confirmation. 3.3. Horizon Expeditions shall take all possible reasonable care to ensure that the applicant and/or members of the applicants party’s provided activities commences as planned and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances. 3.4. Group Bookings (A party of six or more individuals) is subject to additional terms in Section 9.
4. Cancellations
4.1.You are entitled to cancel your booking. Horizon Expeditions reserves the right to raise the following charges:
Within 8 weeks before the programme start: Full Fee Due
Within 8-12 Weeks before the programme start t: 50% of Total Fee Due
Within 12 - 14 Weeks before the programme start: 25% of Total Fee Due
Over 14 Weeks before the programme start: Loss of Deposit unless places can be filled
4.1a Please note that the programme start date is the date of the first meeting / lesson of any programme. 4.1b Please note that in the case of First Aid Courses, no refund will be due in the event of cancelation, regardless of timescale.
4.2. If, due to exceptional circumstances not under Horizon Expeditions control, Horizon Expeditions will be entitled to cancel any booking at any time. In the event that any booking must be cancelled, Horizon Expeditions will use all reasonable measures to notify the applicant as soon as possible. If the booked activity cannot be re-scheduled to the applicant’s satisfaction, the applicant will be entitled to a full refund. No other compensation will be payable. 4.3. If, due to exceptional circumstances not under Horizon Expeditions control, Horizon Expeditions deems it necessary to cease the participation in any on-going activity for reasons of, but not limited to safety, participants will not be entitled to any refund (in part or in whole). In such circumstances Horizon Expeditions may, but will not be obliged to, offer alternative dates or times at no additional cost. 4.4. Group Bookings (A party of six or more individuals) is subject to additional terms in Section 9.
5. Clothing
5.1. It will be the responsibility of all participants to ensure that they are dressed appropriately for the activities being provided. Horizon Expeditions advises participants to wear clothing and footwear appropriate for the activities being provided and for all possible weather conditions. It is advised that the clothing and footwear are such that the participants do not mind them being damaged. In particular the following restrictions will apply: 5.2 Participants may not undertake the Activities in sandals or unlaced shoes (training shoes or walking boots are advised as dependent on the activity) 5.3 Long hair must be tied back 5.4 Scarves are not permitted to be worn during certain activities 5.5 Jewellery and ALL body piercings must be removed or taped over. 5.6 Horizon Expeditions will not be responsible for any damage to or loss of clothing or other personal items of participants resulting from participation in the Activities.
6. Price and Payment
6.1. Subject to any terms agreed in writing between Horizon Expeditions and the applicant, Horizon Expeditions charges will be calculated at our current rates and payment in full shall be due as per supplied invoices. Payment may be made by cheque (payable to Horizon Expeditions) or by Bank Transfer or via the Horizon Expeditions Website where appropriate. 6.2 All prices and costs prior to invoice being supplied are subject to change. 6.3. A provisional booking will be held for a period of 14 days, after which it will automatically released. 6.4. A booking becomes confirmed once a non-refundable deposit has been paid. 6.5. Upon confirmation, a pro-forma invoice will be created for the event based on the requirements and numbers given by the Client. Should these numbers reduce Horizon Expeditions reserves the right to charge. 6.6. Any agreed additional expenses incurred during the provided activity session and not previously covered in the pro-forma invoice, are to be settled upon departure. 6.7. Horizon Expeditions reserves the right to amend it costs in the event of circumstances beyond its control, including but not limited to increases in statutory VAT. 6.8. Any alternative arrangement for payment, for example the agreement to pay in instalments does not affect the cancellation policy as laid out in 4. Cancellations.
7. Refunds
Payments will be refunded in the manner in which they were made.
8. Liabilities
8.1. Except as otherwise provided in these Booking Terms and Conditions Horizon Expeditions shall not be responsible for the loss or damage to any property or injury to any person arising from the participation in the Activities. 8.2. Where parking facilities are available at any activity site, all vehicles and their contents are left at the owner’s risk. 8.3. Except as otherwise provided in the Booking Terms and Conditions any liability of Horizon Expeditions shall be limited to the refund of any charges paid to Horizon Expeditions 8.4. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of Horizon Expeditions in respect of death or personal injury caused by the negligence of Horizon Expeditions or of its employees, agents or contractors.
9. Group Bookings
9.1. A party of six or more individuals will constitute a group booking and will be subject to the following additional terms. 9.2. All payments must be made in full before the activities begin – see cancellation details. Special arrangements can be negotiated where purchase orders/invoices are to be generated. Payment by BACS or cheque must be made within 30 days of the date the invoice was issued. 9.3. Any debts remaining unpaid after 30 days from date of invoice will attract late interest charges of 8% above bank of England base rate in accordance with late payment act 1998 9.4. We require 28 days notice for any change in numbers. Any group cancelling or reducing in numbers within 28 of the activity will be charged in full. Any increase in numbers may incur an additional charge. Reduction in numbers may not result in a reduction of price, regardless of timescale. 9.5. If a discounted price is offered this is based on group size and date given. Should you reduce your group size at any time prior to the event the booking may be re-priced accordingly and further charges may apply. 9.6. If your reserved participant numbers do not attend the activity total cost will still apply. 9.7. Changing course or activity dates will have to be agreed by Horizon Expeditions and may result in an administration fee of £25 being charged. This is at the discretion of Horizon Expeditions 9.8. Horizon Expeditions require any requested dietary and medical requirements 8 weeks in advance of your course.
10. Miscellaneous
10.1. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions. 10.2. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. 10.3. By agreeing to these terms and conditions you give permission to Horizon Expeditions to use any photographs taken of your child whilst participating in the aforementioned activities to be used for publicity purposes.
